4.2 What AskAlfred does not do
AskAlfred is not a content hosting platform. Specifically:
- we do not host, store or reproduce original videos or media from third-party platforms;
- we use embeds, links and metadata reference only;
- we are not a travel agency, booking platform, or tour operator;
- we do not guarantee the availability, accuracy or quality of any third-party content, listing, or booking service.
4.3 Service availability
We will make reasonable efforts to maintain the availability and performance of the Service. However, we do not guarantee uninterrupted access. We may suspend, modify or discontinue all or part of the Service at any time, including for maintenance, updates or commercial reasons, without liability to you.
4.4 Changes to the Service
The Service is subject to ongoing development. We reserve the right to add, remove or modify features and functionalities at our sole discretion. Where a material change significantly affects your use of the Service, we will provide reasonable prior notice.
5. Account registration & security
5.1 Registration
The Service requires you to create an Account. You agree to provide accurate, complete and current information during registration and to keep that information up to date.
5.2 Account security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. You must notify us immediately at info@askalfred.be if you become aware of any unauthorised use of your Account.
You must not share your login credentials with any third party. For security reasons, you must also not disclose your credentials to AskAlfred staff.
5.3 Account suspension and termination
We reserve the right to suspend or terminate your Account at any time if we have reasonable grounds to believe you have violated these Terms, without prejudice to any other rights or remedies available to us.
6. User Content
6.1 Your responsibility
You are solely responsible for all Content you submit, post or share through the Service. By submitting Content, you represent and warrant that:
- you own, or have all necessary rights and licences to submit, the Content;
- the Content does not infringe any intellectual property rights, portrait rights or other rights of any third party;
- the Content complies with all applicable laws, including data protection and privacy legislation;
- the Content does not violate any contractual obligation binding on you, including confidentiality obligations.
6.2 Licence granted to AskAlfred
By submitting Content to the Service, meaning content you yourself have created, including descriptions, annotations, tags, Spot names, lists, ratings and itineraries, you grant AskAlfred a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to use, reproduce, adapt, translate, distribute, display and promote that Content for the purposes of:
- operating and improving the Service;
- promoting the Service and AskAlfred’s business on its own platforms and those of its partners.
This licence applies exclusively to content of your own creation. It does not extend to any Third-Party Content (including videos, images or posts originating from TikTok, Instagram, YouTube or other external platforms) that you reference, link to or embed through the Service. AskAlfred acquires no rights in such Third-Party Content by virtue of these Terms.
You retain all ownership rights in your own Content. This licence terminates when you delete your Content or close your Account, except where your Content has already been shared or distributed in accordance with these Terms.
6.3 Prohibited content
You must not submit, post or transmit any Content that:
- is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, hateful or otherwise objectionable;
- infringes any third-party intellectual property, privacy, or personality right;
- impersonates any person or entity;
- constitutes unsolicited commercial communications (spam);
- contains malicious code, viruses or other disruptive elements;
- relates to or promotes the political, philosophical or religious views, union membership, health or sexual orientation of any third party without their consent.
6.4 Content moderation
AskAlfred has no general obligation to monitor Content on the Service. Upon becoming aware of potentially unlawful Content or activity, AskAlfred reserves the right to:
- request that you promptly remove such Content;
- remove or restrict access to any Content or Account, with or without prior notice depending on the urgency and nature of the situation.
Where practicable, AskAlfred will notify you of any such action and provide its reasons, unless doing so would compromise a legal obligation, an ongoing investigation, or the rights of third parties. You may contest any such decision by contacting AskAlfred at info@askalfred.be.
Taking such action does not give rise to any liability on our part, even if the relevant Content is subsequently determined to have been lawful.
7. Third-Party Content & IP
7.1 Nature of Third-Party Content
The Service allows you to link to, embed or reference content from third-parties. This includes content from TikTok, Instagram, YouTube, blogs and similar sources. AskAlfred does not host, reproduce or control Third-Party Content.
7.2 Your obligations regarding Third-Party Content
When linking to or referencing Third-Party Content through the Service, you are solely responsible for ensuring that your use of such content complies with:
- the intellectual property rights of the Content’s creator(s);
- the terms of service and API/embedding policies of the relevant platform;
- applicable copyright and neighbouring rights legislation.
AskAlfred accepts no liability for any infringement of third-party rights arising from your use of Third-Party Content.
7.3 AskAlfred’s intellectual property
All software, design, branding, databases, algorithms and other elements of the Service (excluding User Content and Third-Party Content) are the exclusive property of AskAlfred or its licensors and are protected by copyright, database rights, trademark rights and other intellectual property laws.
You may not copy, reproduce, distribute, create derivative works from, publicly display or otherwise exploit any part of the Service without our prior written consent.
8. Affiliate links & commercial relationships
8.1 Affiliate model
Spots on the Service may include Affiliate Links to third-party booking and travel services. When you complete a booking or purchase via an Affiliate Link, AskAlfred may receive a commission from the third-party provider.
8.2 Third-party booking services
Affiliate Links direct you to independent third-party platforms. AskAlfred is not a party to any agreement you enter into with those platforms and accepts no liability for:
- the accuracy, availability or quality of third-party listings;
- any transaction, dispute or loss arising from a booking made via an Affiliate Link;
- any changes to pricing, availability or booking conditions by the third-party provider.
We recommend that you review the applicable terms and policies of any third-party service before making a booking.
9. Platform & scraping policy
9.1 Permitted use
You may use the Service only for its intended purpose: organising and curating personal travel content. Any systematic automated access to or extraction of data from the Service (scraping) is strictly prohibited.
9.2 Compliance with platform terms
If you integrate content from third-party platforms (TikTok, Instagram, etc.) into the Service, you are responsible for ensuring that your method of accessing that content (manual input, official API, or embedding) complies with the relevant platform’s terms of service. AskAlfred does not authorise or facilitate any access that violates third-party platform rules.
9.3 Platform dependency
The Service may rely on embeds and APIs provided by third-party platforms. AskAlfred cannot guarantee continued access to those platforms’ features or APIs. Changes to third-party platform policies may affect the functionality of the Service.
10. Creator Programme
10.1 Eligibility
The Creator Programme is an optional arrangement available to eligible Users who generate travel content associated with the Service. Participation is subject to separate eligibility criteria communicated by AskAlfred from time to time.
10.2 Revenue sharing
Eligible Creators may receive a share of the revenue generated through their associated content, as determined by AskAlfred’s Creator Programme terms, which form a separate agreement. The applicable revenue-sharing rate, calculation methodology and payment terms will be set out in that separate agreement.
10.3 Independent contractor
Creators are independent contractors. Nothing in these Terms or the Creator Programme creates any employment relationship, agency, partnership or joint venture between AskAlfred and any Creator.
10.4 Right to modify or terminate
AskAlfred reserves the right to modify or terminate the Creator Programme at any time, subject to reasonable prior notice to active participants.
11. Privacy & Data Protection
11.1 Privacy Policy
The processing of personal data in connection with the Service is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
11.2 Cookies & tracking
We may use cookies and similar tracking technologies as described in our Cookie Policy. Where required by law, we will obtain your consent before deploying non-essential cookies.
12. Prohibited use
In addition to the Content restrictions in Section 6.3, you must not:
- use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- attempt to circumvent, disable or interfere with any technical security measures protecting the Service;
- use automated tools (bots, crawlers, scrapers) to access, collect or extract data from the Service;
- reverse-engineer, decompile or disassemble any part of the Service;
- interfere with the integrity or performance of the Service or its underlying infrastructure;
- use the Service in a way that could damage AskAlfred’s reputation or business interests;
- resell, sublicence or otherwise commercially exploit the Service without prior written authorisation.
13. Disclaimers & limitation of liability
13.1 Best-efforts obligation
Unless expressly agreed otherwise in writing, AskAlfred’s obligations under these Terms are best-efforts obligations. AskAlfred undertakes to provide the Service with reasonable care and skill but does not guarantee any specific result or outcome.
13.2 “As is” provision
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, AskAlfred excludes all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. AskAlfred does not warrant that the Service will operate error-free, uninterrupted, or free from viruses or other harmful components, nor that any defects will be corrected.
13.3 No warranty for third-party content or links
AskAlfred does not warrant the accuracy, completeness or legality of any Third-Party Content or any content accessible via Affiliate Links or hyperlinks within the Service. You access such content entirely at your own risk. AskAlfred is not responsible for the acts or omissions of any third-party platform or service provider whose content is referenced, embedded or linked within the Service.
13.4 Automated translation
The Service may use automated translation tools to display content in multiple languages. Such translations are provided for informational purposes only and may be inaccurate. AskAlfred accepts no liability for any damage, loss or misunderstanding arising from translated content. Where accuracy is material, users should consult the original source language version.
13.5 Exclusion of specific categories of loss
You may only claim compensation for damages resulting from AskAlfred’s wilful misconduct or gross negligence, or — absent force majeure — from AskAlfred’s failure to perform an essential obligation under these Terms. In no event shall AskAlfred be liable for:
- any indirect, incidental, special, consequential or punitive damages, including but not limited to: loss of profits or revenue, loss of data or goodwill, loss of business opportunity, increased overhead costs, missed savings, damage from business interruption, loss of anticipated savings, loss of capital, loss of customers, missed opportunities, damage to or loss of files, or claims by your own customers or users;
- any damage caused by your own acts, omissions or negligence;
- any direct or indirect damage arising from your use of, or reliance on, the output or results generated by the Service;
- any direct or indirect damage caused wholly or partly by software, hardware, APIs or services supplied or operated by third parties, or by any element introduced into your environment after the date of your agreement with AskAlfred;
- any loss or misuse of your login credentials by a third party;
- any damage inherent to the use of the internet, including interruptions, viruses, bugs, software errors or telecommunications failures;
- any claims brought against you by third parties.
13.6 Intellectual property claims
AskAlfred is not liable for any claim of intellectual property infringement arising from: (i) your use of a modified or outdated version of any component of the Service, where the infringement would have been avoided by use of the current unmodified version made available by AskAlfred; or (ii) content, designs, specifications, instructions, data or other materials not developed or provided by AskAlfred.
13.7 Aggregate liability cap
To the maximum extent permitted by applicable law, AskAlfred’s total aggregate liability to you — whether in contract, tort (including negligence), statute or otherwise — for all claims arising under or in connection with these Terms shall not exceed the total fees paid by you to AskAlfred in the twelve (12) months preceding the event giving rise to the claim. Where AskAlfred’s liability is covered by an insurance policy providing a higher indemnity, the maximum liability shall be capped at the amount effectively covered by the insurer, without this constituting any obligation on AskAlfred to take out or maintain any specific insurance.
13.8 Concurrent liability of third parties
Where damage is caused in part by third parties, AskAlfred’s liability shall be limited to the portion of damage directly attributable to its own fault or negligence. AskAlfred shall not be jointly and severally liable with any such third parties.
13.9 Force majeure
Force majeure events, and more generally any circumstances that prevent, reduce or delay AskAlfred’s performance, or that disproportionately increase the burden of performance, release AskAlfred from any liability. Depending on the circumstances, AskAlfred may reduce its obligations, suspend performance or terminate the agreement, in each case without any obligation to pay compensation.
Force majeure includes, without limitation: war, civil unrest, mobilisation, riots, strikes and lockouts (whether at AskAlfred or its suppliers), equipment failure, computer viruses or bugs, fire, water damage, energy supply interruptions, cyberattacks, third-party platform outages, epidemics or pandemics, and restrictions or prohibitions imposed by any governmental authority.
13.10 Limitation period for claims
Any claim against AskAlfred must be brought promptly. Without prejudice to any shorter period under applicable law, all claims against AskAlfred shall in any event lapse if not filed in court within two (2) years from the date on which you discovered, or could reasonably have discovered, the circumstances giving rise to the claim.
13.11 Claims against affiliated persons
You agree to direct any claims arising out of or in connection with the Service exclusively against AskAlfred, and not against its directors, officers, employees, subcontractors or other agents acting on its behalf. To the extent any claim against such persons is nevertheless permitted by law, the liability limitations and exclusions set out in this Section 13 apply mutatis mutandis to any such affiliated persons.
14. Indemnification
You agree to indemnify, defend and hold harmless AskAlfred and its officers, directors, employees, agents and licensors from and against any claims, damages, losses, costs and expenses (including reasonable legal fees) arising from or relating to:
- your use of the Service in violation of these Terms;
- Content you submit to the Service;
- your infringement of any intellectual property or other rights of any third party;
- your violation of any applicable law or regulation.
15. Right of withdrawal
If you are a consumer you have in principle the right to withdraw from a distance contract within 14 calendar days without giving any reason.
However, by expressly requesting immediate access to the Service upon registration or purchase, you acknowledge and agree that performance of the Service begins immediately. You explicitly waive your right of withdrawal to the extent permitted by applicable law.
This waiver applies to any digital content or digital service that is made available to you immediately upon conclusion of the agreement, including access to premium features or participation in the Creator Programme.
16. Modifications to these Terms
We reserve the right to modify these Terms at any time. Where changes are material, we will provide reasonable advance notice (e.g., via in-app notification or email). Continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
If you do not agree to the revised Terms, you may close your Account at any time at no charge.
17. Term & termination
17.1 Term
These Terms remain in effect for as long as you use the Service or maintain an Account.
17.2 Termination by you
You may terminate these Terms at any time by deleting your Account.
17.3 Termination by us
We may terminate or suspend your access to the Service immediately, without notice, if you breach these Terms or if we discontinue the Service.
17.4 Effect of termination
On termination, your right to access and use the Service ceases immediately. Sections 6.2, 7.3, 11, 13, 14 and 18 survive termination.
18. Third-Party services
The Service may integrate with or link to third-party services (payment processors, mapping services, booking platforms, social media platforms, etc.). These third-party services are governed by their own terms and privacy policies, which you are responsible for reviewing. AskAlfred is not responsible for the content, policies or practices of any third-party service.
19. Governing law & dispute resolution
19.1 Governing law
These Terms are governed by and construed in accordance with Belgian law, without prejudice to any mandatory consumer protection laws that may apply in your country of residence.
19.2 Jurisdiction
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the judicial district of West Flanders, Belgium, subject to any mandatory statutory provisions conferring jurisdiction on the courts of your place of residence (where applicable to consumers).
19.3 Informal resolution
Before initiating formal proceedings, we encourage you to contact us at info@askalfred.be to seek an informal resolution.
20. General provisions
20.1 Entire agreement
These Terms, together with our Privacy Policy, Cookie Policy and any Creator Programme agreement, constitute the entire agreement between you and AskAlfred with respect to the Service and supersede all prior agreements.
20.2 Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or, if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
20.3 No waiver
Failure by AskAlfred to enforce any provision of these Terms on any occasion shall not constitute a waiver of that provision or AskAlfred’s right to enforce it subsequently.
20.4 Assignment
AskAlfred may assign its rights and obligations under these Terms to any affiliate or in connection with a merger, acquisition or sale of assets, without your prior consent. You may not assign or transfer your rights or obligations under these Terms without AskAlfred’s prior written consent.
20.5 Language
These Terms are drafted in English. In the event of any conflict between an English version and any translation, the English version shall prevail.
